Getting a Pet Back in Cook County

Chicago and suburban Cook County pet disputes are handled by the Circuit Court of Cook County. Here's how the main paths work.

Where Cases Are Heard

  • Divorce-related pet issues: Domestic Relations Division, Daley Center, downtown Chicago.
  • Non-divorce recovery cases: the Municipal Department, at the Daley Center or the suburban courthouse for the district where the defendant lives.

Replevin

Replevin (735 ILCS 5/19-101 and following) is a court action to recover specific property wrongfully kept from you. It asks for the return of the animal itself, not just money. It usually requires proof of ownership and a court hearing before an order issues.

Small Claims

Illinois small claims cases cover claims up to $10,000 and use simpler procedures. Our flat-fee pet recovery lawsuit covers filing and handling a small claims case short of trial.
