Illinois Pet Recovery Lawsuit

If the other side ignored the demand letter, a small-claims recovery action asks the court to order the pet returned.

Illinois law changes January 1, 2027

Rosie’s Law adds companion-animal provisions to replevin for qualifying unmarried partners and roommates who shared responsibility for care. Shared care does not automatically establish ownership or guarantee shared custody.

Replevin and detinue, explained

Replevin asks the court to return specific property to its owner; detinue seeks the return of the property or its value. Both focus on who owns the animal and who has the right to possess it.

Evidence you'll need

Effective January 1, 2027, Rosie’s Law permits consideration of well-being and care evidence in companion-animal possession disputes. Qualifying unmarried partners and roommates must demonstrate shared care responsibility; shared care does not automatically confer ownership. Ask which procedure and remedies fit your case.

  • Adoption, purchase, or breeder records.
  • Microchip and license registration.
  • Vet, insurance, and payment records.
  • Texts or emails about the pet and the demand letter.

Not sure what you have? Use the evidence checklist. Haven't sent a demand yet? Start with the $165 letter.
