Pet Disputes in DuPage, Lake and Will Counties

Suburban pet disputes follow the same Illinois law as Chicago, but each county has its own courthouse and procedures.

The Courthouses

  • DuPage County: 18th Judicial Circuit, Wheaton.
  • Lake County: 19th Judicial Circuit, Waukegan.
  • Will County: 12th Judicial Circuit, Joliet.

The Same Illinois Law Applies

In divorce, 750 ILCS 5/503(n) lets judges consider the well-being of a companion animal when allocating ownership. Outside divorce, recovery usually runs through replevin or small claims.

Local Practice Tips

  • Check the county's local rules and e-filing requirements before filing.
  • Bring organized copies of your ownership evidence to every hearing.
  • Many suburban cases settle at the demand letter or mediation stage.
